Terms of Service

These terms cover your use of this website and the design, branding and development services we provide. The specifics of any project live in a separate written proposal — these terms are the backdrop to it.

Using this website

This site and everything on it — the writing, design, layout, code, graphics and brand assets — belongs to Heartiee / Heartiee Weband is provided for information. You may browse and share links to it, but please don’t copy, scrape, republish or reuse any part of it for your own commercial purposes without our written permission.

Our services

Heartiee Web provides graphics and branding, UI/UX design, and bespoke web design and development — along with related custom software. Every engagement is defined by its own written proposal or agreement that sets out the scope, deliverables, timeline and fees. If anything in a signed proposal conflicts with this page, the signed proposal takes precedence.

Quotes and proposals

A quote is an estimate based on the brief you give us at the time. If the scope grows or the requirements change, the cost and timeline may change with it — we’ll always talk it through and confirm in writing before doing the extra work.

Fees and payment

Projects are usually billed in milestones — for example a deposit to begin and the balance on delivery — as set out in your proposal. Invoices are payable within the period stated on them. We may pause work on a project while an invoice is overdue.

Revisions and approvals

Each proposal includes a defined number of revision rounds at the relevant stages. Your written sign-off marks a stage as complete and lets us move on. Changes requested after sign-off, or beyond the agreed rounds, may be quoted and billed as additional work.

Ownership of the work

Once a project is paid in full, ownership of the final, approved deliverables transfers to you, as set out in your proposal. Our pre-existing tools, frameworks, source libraries, components and internal methods — the things we bring to every project — remain ours. Unless we’ve agreed otherwise (for example under an NDA), we may show the completed work in our portfolio and case studies.

Your responsibilities

To keep a project on track, you agree to provide accurate content, assets and brand materials, and timely feedback and approvals. You also confirm that you own — or have the right to use — any text, images, logos or other materials you supply to us, and that they don’t infringe anyone else’s rights.

Third-party services

Projects often rely on third-party platforms and services — hosting, domains, fonts, plugins, payment and analytics tools, and APIs — each governed by its own terms. We’ll recommend sensible choices, but we aren’t responsible for those providers’ availability, pricing or changes.

Warranties and disclaimer

We deliver our work with professional skill and care. Beyond that, this website and our services are provided “as is”, and we don’t make other warranties — express or implied. We can’t guarantee specific business outcomes, search rankings, traffic or uninterrupted, error-free operation.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of an engagement is limited to the fees you paid us for that engagement. We are not liable for indirect, incidental or consequential losses, including lost profits, revenue or data.

Governing law

These terms are governed by the laws of India, and the courts at Chandigarh have exclusive jurisdiction over any dispute, unless your signed proposal states otherwise.

Changes to these terms

We may update these terms from time to time. The current version is always the one published here, dated above; continuing to use the site means you accept it.
